Terms of Service

1. Acceptance of Terms

By accessing or using the Neshys platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including workspace owners, members, and any person accessing the platform.

2. Description of Service

Neshys is a PR and media outreach platform designed for public relations agencies and freelancers. The Service provides the following capabilities:

  • Contact management for journalists and media professionals
  • Email campaign creation, scheduling, and delivery
  • AI-powered content generation for personalized pitches
  • Email delivery tracking including opens, clicks, bounces, and complaints
  • Workspace-based collaboration with role-based access
  • Custom sending domain verification and management

3. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. Specifically, you must:

  • Comply with the CAN-SPAM Act, GDPR, and all applicable email marketing regulations
  • Not send spam, unsolicited bulk email, or any form of malicious content
  • Have a legitimate professional basis for contacting each recipient (e.g., existing media relationship, relevant press inquiry)
  • Honor all unsubscribe and opt-out requests promptly
  • Not use the Service to harass, threaten, or send abusive communications
  • Not attempt to circumvent the platform's suppression list or bounce handling mechanisms
  • Maintain accurate and up-to-date contact information

Violation of these acceptable use requirements may result in immediate suspension or termination of your account.

4. Email Sending

Emails sent through the Neshys platform are delivered via Amazon Simple Email Service (Amazon SES). By using the Service, you acknowledge and agree to the following:

  • You are solely responsible for the content of all emails sent through your account
  • The platform tracks email engagement metrics including delivery confirmations, opens, and clicks to help you measure campaign effectiveness
  • Email addresses that generate hard bounces or spam complaints are automatically added to a suppression list to protect sender reputation and deliverability
  • Sending volume is subject to rate limits and plan-based quotas
  • We reserve the right to suspend email sending for any account that exhibits patterns of abuse or generates excessive bounces or complaints

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including your password and any API keys associated with your workspace. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

6. Intellectual Property

The Neshys platform, including its design, features, code, and documentation, is the intellectual property of Neshys and is protected by applicable copyright, trademark, and other intellectual property laws.

You retain full ownership of all content you create, upload, or transmit through the Service, including email templates, campaign content, and contact data. We do not claim any ownership rights over your content or contacts. We will not use your content for any purpose other than providing and improving the Service.

7. Workspace and Billing

The Service is organized around workspaces. Each workspace operates under a subscription plan that determines available features and usage limits (such as email sends and AI requests per billing cycle).

  • Billing is per workspace, not per user
  • Usage limits (email sends, AI requests) are tracked per billing cycle
  • Subscription plans may include a trial period for eligible plans
  • You are responsible for all charges incurred by your workspace
  • We reserve the right to modify pricing with reasonable advance notice

8. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms. Violations related to email abuse, spam, or non-compliance with email regulations may result in immediate suspension without prior warning.

You may terminate your account at any time by deleting your account through the platform settings. Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Neshys and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
